HOW TO PARTICIPATE IN THE PROGRAM:
GENERAL:
Participants in the Program agree that their relationship is independent of Company, SUCCEED and the SUCCEED Challenge.
ELIGIBILITY:
The SUCCEED Challenge is available U.S. residents only, 18 years or older, who have not purchased and/or used SUCCEED in any other form within the last 5 years, and who possess a ship-to address in the 48 contiguous United States (i.e., not available in Alaska or Hawaii, or outside the U.S.).
ORDERS AND SHIPPING:
Company will generally process and ship all SUCCEED Challenge orders on the next Monday following placement of the order. Thus, orders placed Monday through Sunday will ship on the next Monday. If Monday is a holiday, those orders will ship the next day, Tuesday. No orders are processed or shipped during the weeks of Christmas or New Years. Check website for specific dates as notification of holiday operations will be posted each December. Product is shipped via Fed Ex Ground. MONEY BACK GUARANTEE RULES AND LIMITATIONS:
Company insists that you take the SUCCEED Challenge entirely at its risk financially. As a result, the SUCCEED Challenge comes with a 100% Money Back Guarantee. If Participant completes the entire 60-day Program and is not satisfied with the benefits and improvements in the horse, Company will refund entire purchase price to Participant.
The Money Back Guarantee is available on either SUCCEED Granules or SUCCEED Paste Challenge Pack, to any Participant who completes the entire SUCCEED Challenge 60-day Program. Participants who do not comply with all requirements of the Program, including but not limited to using the product daily through all 8 weeks of the program, are not eligible.

NO LIABILITY:
All Participants assume all risks associated with participating in the SUCCEED Challenge. Participants and their trainers and veterinarians agree to release and hold harmless Company, its officers, directors, employees and agents of any and all liability from loss, risk, damage, or injury that may occur from participating in the SUCCEED Challenge. Participants agree to indemnify Company and the SUCCEED Challenge, their officers, directors, employees, and agents (collectively “Company”) for all legal costs, including attorneys fees, in the event that Company is named in, or threatened to be named in, any lawsuit, arbitration, mediation, or other legal or equitable action arising from their participation in the SUCCEED Challenge Program.
CHOICE OF LAW AND VENUE:
Except where prohibited, Participants agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Program shall be resolved individually, without resorting to any form of class action, and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the SUCCEED Challenge, but in no event attorneys’ fees; and (3) under no circumstances will Participant be permitted to obtain awards for and Participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Participant in connection with the Program, shall be governed by, and construed in accordance with, the laws of the State of Wisconsin, without regard for conflicts of law doctrine, and all proceedings shall take place in Rock County in the State of Wisconsin.
